In consideration for being permitted to use the private swimming pool located at 1003 Hemingway Drive, College Station, TX 77845 (the "Pool"), I, the undersigned parent or legal guardian of the swimmer named above, on behalf of myself, my child, and our heirs, executors, administrators, successors, and assigns, agree as follows:

In consideration for being permitted to use the private swimming pool located at 1003 Hemingway Drive, College Station, TX 77845 (the "Pool"), I, the undersigned participant, on behalf of myself and my heirs, executors, administrators, successors, and assigns, agree as follows:

• I understand that swimming, diving, and any use of the Pool and surrounding property involve INHERENT RISKS, including but not limited to drowning, near-drowning, slips, falls, injuries from diving boards or slides, contact with the pool surface or other swimmers, weather exposure, communicable illness, and other physical injuries — some of which may be serious or life-threatening.
• I VOLUNTARILY ASSUME ALL SUCH RISKS, both known and unknown, and accept full personal responsibility for any injury, loss, or damage to myself or my childmyself arising out of use of the Pool.
• I represent that my child isI am physically able to safely be in and around a swimming pool. I will inform the Pool owners in writing of any medical condition that may affect my child'smy safety.
• I authorize the Pool owners to seek and consent to emergency medical treatment for my childme if I cannot be reached, and I agree to be financially responsible for any such care.
• I agree to RELEASE, WAIVE, DISCHARGE, AND HOLD HARMLESS the property owners Micah Flippen and Allison Flippen, and Lillie Flippen, at 1003 Hemingway Drive, College Station, TX 77845, and their respective family members, heirs, agents, and representatives (collectively, the "Released Parties") from any and all claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury — including death — sustained by me or my childme while using or in connection with the Pool, EVEN IF CAUSED BY THE NEGLIGENCE of the Released Parties, to the fullest extent permitted by Texas law.
• I agree to INDEMNIFY AND HOLD HARMLESS the Released Parties from any loss, liability, damage, or cost they may incur due to my or my child'smy use of the Pool.
• This Agreement is governed by the laws of the State of Texas. If any portion is held invalid, the remainder shall continue in full force and effect.

General safety

• Listen to the pool owners at all times; get out of the pool immediately if asked.
• Let the pool owners know of any health concerns, recent injuries, or physical issues before entering the pool.
• An adult must be present at the pool with any swimmer under 12.
• Look before you leap.
• No running.
• No horseplay, dunking, or pushing.
• Be aware of who you are swimming with and look out for each other.
• Long hair should be tied back during swimming.
• Get out of the pool if you hear thunder; stay out for 30 minutes after the last thunder.

Diving boards & slide

• One person at a time on the springboard.
• One person at a time jumping off the high dive or slide. Others may wait on the platform.
• No horseplay on the high dive or springboard.
• Don't put a float under the high dive or springboard.
• Remove lane lines before using the high dive or the springboard.
• Remove goggles before jumping off the high dive or the springboard — hold them in your hand or throw into the water.
• No diving in the shallow end.
• Water must be on to use the water slide.

Hygiene & pool care

• Pee in the bathroom, not the pool.
• The pool is not for cleaning your feet — use the outdoor shower if needed.
• No food in the pool.
• No glass containers in the pool area.

Property & modesty

• No alcohol.
• No two pieces in mixed company (boys and girls). Please wear a t-shirt over your suit if that's all you have.
